These terms apply to every project and service that SwiftCode provides. Together with the written quote you accept, they form our agreement with you. If your quote says something different from these terms, the quote applies.
1. Who we are
Swift Code is a company owned by Almen Grami, Rruga Isuf Sokoli, Shkodër, Albania. Contact: support@swift-code.dev.
Our services are for businesses and professionals, not for private consumers.
2. Packages and steps
Every project follows up to four steps. Your package decides which steps are included:
- Plan and design: all packages
- Build with secure code: all packages
- Security audit: Pro
- Secure launch: Standard and Pro
The exact scope, the price of each step and the timeline are written in your quote. Work starts once you accept the quote in writing (email is enough).
3. Payment
- You pay for each step separately, at the price set for that step in your quote.
- We send an invoice for each step. The payment deadline is written on the invoice.
- Prices are in euros, unless your quote says otherwise.
- Hosting is billed monthly (see section 7).
4. Changes
Until you approve the plan and design, changes are free and included in your quote. Once you approve them, the scope, price and timeline are fixed. Any change after that is new work: we send you a separate quote first, and nothing extra is billed without your written OK.
5. Review and approval
At the end of each step, we show you the result. If something does not match what was agreed, tell us during the review and we fix it before the step is approved. After the final step is approved, new requests, changes, bug fixes and maintenance are billed separately, unless you have a hosting and maintenance plan that includes them.
6. Cancellation
You can cancel a project at any time by writing to us. You only pay for the steps and work completed up to that point, and you receive everything we have delivered so far.
7. Hosting
With Standard and Pro, your app goes live in one of two ways:
- On your own server: we install your app, put it into operation and harden the server. The server, its provider and its costs stay your responsibility.
- On our servers: we host your app on servers from Hetzner in Germany, either on a shared cloud server where your app runs in its own isolated environment, or on a server dedicated only to you. The monthly fee is the server cost charged by the provider plus €100 per month for maintenance.
If a monthly hosting invoice is not paid, we will remind you in writing before we pause the service. Either side can end the hosting service in writing. When hosting ends, we hand over your app and its data before anything is deleted.
8. Ownership of the code
Once the work has been paid for, you own the full code and the designs we created for you. Open-source components used in your app keep their own licenses.
We may mention your project as a client example, without any code or technical details, only if you agree to it.
9. Your responsibilities
- Give us the information, content and access we need on time. Delays on your side can move the timeline.
- Make sure the content and data you give us may be used legally.
- For apps that handle personal data, you are the data controller. When we host or process that data for you, we sign a data processing agreement with you.
10. Security work
We build every app with secure coding practices and test it carefully. A security audit shows the state of your app at the time of testing. No system can be guaranteed to be completely secure, and new risks can appear later, for example after updates or changes made by others.
11. Liability
Our total liability for any claim related to a project is limited to the amount you paid us for that project. For hosting, it is limited to the fees you paid in the last 12 months. We are not liable for indirect losses, such as lost profit, lost revenue or lost business.
We are also not liable for:
- Lost data: you are responsible for keeping your own backups. If we host your app, our responsibility is limited to restoring your data from our latest backup.
- Events outside our control: outages, delays or damage caused by events we cannot reasonably control, such as failures of hosting or internet providers, attacks on third-party services, power cuts, natural events or decisions of public authorities.
- Third-party services: faults in services that your app uses or that you chose, such as payment providers, email services, app stores or external APIs.
- Changes by others: problems caused by changes made to your app or server by you, your staff or other developers after we delivered our work.
Any claim must be reported to us in writing within 12 months after the work it relates to was delivered.
These limits do not apply where the law does not allow them, for example for damage caused on purpose or by gross negligence.
12. Confidentiality
We keep your business information, ideas, code and data confidential, and we only use them to work on your project.
13. Law and disputes
These terms are governed by the laws of the Republic of Albania. If we cannot solve a disagreement together, the competent court in Shkodër, Albania, will decide.
14. Changes to these terms
We may update these terms. The version in force when you accept your quote applies to your project.
